Promoting the Rule of Law through Fair Evidence Practice

On 21 March 2024, BABSEACLE organised the Asia Fair Trial Practices Roundtable on Promoting the Rule of Law through Fair Evidence Practice. Bruce Lasky, Co-Founder/Co-Director of the not-for-profit organisation BABSEACLE, moderated the roundtable session. The event was attended by legal sector participants from the Asia region and around the globe. The roundtable kicked off with a conversation among experienced legal practitioners including Gopinath Pillai, a legal counsel from Singapore; Jake Stevens, a Strategic Advisor for Legal Aid and Practice at MyJustice; Jane Sanders, a Principal Solicitor at Shopfront Youth Legal Centre; Saroj Ghimire, an Attorney at Law at Supreme Court of Nepal; and Warisha Farasat, a Delhi-based lawyer.
The roundtable explored constructive ways and means to strengthen fair trial processes and the rule of law, emphasising the need for fair evidence practice to ensure a fair trial, including the exclusion of improperly obtained statements or confessions, evidence obtained through warrantless searches and seizures, evidence that was maintained through an improper chain of custody. The discussion also included a presentation on different jurisdictional burdens of proof and procedural timing related to excluding improperly obtained evidence.
The event has built an engaged network of people to collaborate in promoting and protecting the right to a fair trial and to share their experiences, successes, challenges, and other things in obtaining a fair trial.
