Asia Virtual Mock CLE Evidence Exclusionary Hearing Event

Event Rounds and Teams

It is important to remember that the main goal of the the 2023 Asia Virtual Mock CLE Evidence Exclusionary Hearing Event is for it to be a Justice Education/Clinical Legal Education learning experience, and not a competition but is a Justice Education/Clinical Legal Education learning experience. Therefore, although participants are placed in teams with the aim of advancing to the next round, the overriding goal is to learn and share with others from experience, improve your legal skills, and equally important, strengthen your understanding and appreciation of Fair Trial and Rule of Law principles.

The 2023 Asia Virtual Mock CLE Evidence Exclusionary Hearing Event will consist of 3 Rounds, with 2 trials in Round 1, 2 trials in Round 2, and 1 trial in Round 3. Each trial will take 2 1/2-3 hours.

Selected Participants will be divided into 2 teams (Team 1 and Team 2) of 12 Participants each.

Each team will take turns playing the roles of prosecution and defence.

Morning Round: Team 1 will act as a prosecution, and Team 2 will serve as a defence.

Afternoon Round: Team 1 will now be a defence, and Team 2 will now be a prosecution.

By participating in this round, Participants will gain practical experience and receive constructive feedback from judges.

Morning Round 8:30 AM – 12 PM (Bangkok Time)

• Team 1 (Prosecution) vs Team 2 (Defence)

Afternoon Round 1 PM – 4 PM (Bangkok Time)

• Team 1 (Defence) vs Team 2 (Prosecution)

Team participants must assign roles for their team, with the following roles:

Prosecution team:

• 2 Prosecutors
• 3 Witnesses
• 1 Clerk

Gender Balance Rules

(When choosing the prosecutors and witnesses there must be gender balance¸ meaning there must be 2 different genders in the role of prosecutors, and at least 2 different genders in the role of the witnesses, and change the gender of the Clerk in the morning and the afternoon)

Defence team:

• 2 Defence Lawyers
• 3 Witnesses
• 1 Clerk

Gender Balance Rules

(When choosing the defence lawyers and witnesses there must be gender balance¸ meaning there must be 2 different genders in the role of the defence lawyers, and at least 2 different genders in the role of the witnesses, and change the gender of the Clerk in the morning and the afternoon)

Here are the rules of role switching:

1. Participants who played prosecutors or defence lawyers roles in during the morning of Round 1 must switch roles, to be either witnesses or backup.
2. The gender balance rules described above apply.

In Round 2, both morning and afternoon, the team participants will switch roles, and those who played the roles of prosecutors or defence lawyers in the Round 1 will now act as witnesses or backup, and vice versa.

Here are the rules of role switching:

1. Participants who played prosecutors or defence lawyers roles in during Round 1, and/or the morning of Round 2, must switch roles, to be either witnesses or backup.
2. The gender balance rules described above apply.

Round 2-Afternoon Session-Participants as Judges/Evaluators

Some/all of the Defence and Prosecution Team members who will not be playing roles in the Round 2 afternoon session will be chosen to be judges/evaluators of the teams during this session.
